[Contents]
Ce volume regroupe des communications présentées lors du XXXVIIe colloque international du GIREA. Il contient de nouvelles propositions pour la compréhension de l’esclavage. Les réflexions qui constituent ce volume réinterrogent des problématiques et des résultats qui semblaient acquis pour les historiens, les philologues, les philosophes, les anthropologues ou les sociologues. Il est aujourd’hui évident que l’esclavage plonge ses racines concrètes et conceptuelles dans les formes de pensée les plus anciennes. Les études récentes montrent que la réalité de l’esclavage obéit à des facteurs complexes sur les plans économique, psychologique et social dans de très nombreuses cultures.

    El desarrollo de la Hermenéutica desde el siglo xix, permite profundizar en las relaciones sociales de la Antigüedad clásica. En este caso se pretende analizar los usos del término douleía y los emparentados etimológicamente. Su uso está claramente condicionado por la realidad histórica misma, lo que muestra el carácter histórico de la Hermenéutica.     The development of hermeneutics since the 19th century allows going in depth into the social relations of Classical Antiquity. In this case, the uses of the term douleia and the ones etymologically related are analyzed.     Peut-on penser la servitude quand on est stoïcien ? Quelques réflexions pour une herméneutique de l’esclavage
    [Résumé]

    L’idée que le stoïcisme a, dès ses origines, développé une philosophie originale y compris sur les questions de l’esclavage est une idée très largement répandue parmi les chercheurs sur l’esclavage. Une telle conception repose très souvent sur une lecture rapide des sources et bien plutôt de la littérature scientifique qui s’en inspire. Dès lors que l’on se plonge dans une lecture serrée des sources, on se rend compte de la rareté des témoignages avant l’époque romaine et de leur difficulté d’interprétation. Si, globalement, les stoïciens sont favorables à une conception unitaire de l’ humanité, il n’en découle pas une égalité historique. En effet, si du point de vue du droit naturel les hommes sont égaux, du point de vue social l’ inégalité reste une règle structurelle de la conception des rapports humains. De ce point de vue, le stoïcisme rejoint certaines conceptions de l’aristotélisme. Mots-clés : Stoïcisme, Esclavage, Droit naturel, Philosophie, Égalité/Inégalité, Herméneutique.

  • Can one Conceptualize Servitude if one is a Stoician? A few Insights into the Hermeneutics of Slavery
    [Résumé]

    The fact that, from the start, Stoicism evolved an original philosophy encompassing the questions of slavery is widely accepted among academics who specialize on slavery. This assumption relies on academic literature drawing inspiration from a rather hasty reading of sources. But as you begin to read these sources more closely, you realize how rare pre-Roman testimonies are and how difficult to interpret they are. If indeed, by and large, the Stoicians agree with a unitary conception of humanity, it does not follow that equality actually happened in history. As a matter of fact, if all men are equal from the point of view of natural law, from a social perspective inequality remains structural in the conception of human relationships.     De éxodos y esclavitudes. Leer la Biblia con los ojos de los cananeos. In memoriam Edward Said

    El segundo libro de la Torá hebrea –Éxodo– es leído por la teología de la liberación como un texto paradigmático de la ruptura con la esclavitud. Más allá de las discusiones interdisciplinarias en las que arqueólogos e historiadores niegan el hecho histórico del éxodo de Egipto allí narrado, la concepción crítica de la esclavitud destaca en la lectura de sus páginas. Para el Éxodo la servidumbre es coyuntural, temporaria, y siempre fija sus miras en la recuperación de la libertad. Desde el punto de vista filosófico contemporáneo, la ética heterónoma levinasiana se nutre de la sensibilidad antiesclavista bíblica, de la memoria del esclavo, para labrar cuidadosamente su noción de “difícil libertad”. Coherentemente con la heteronomía de Levinas, en calidad de lectores heterónomos, escucharemos el llamado del pensador palestino Edward Said a “leer la Biblia con los ojos de los cananeos”. Atenderemos esta interpelación al compás del coro de los esclavos hebreos de la ópera Nabucco de Verdi. Desde el punto de vista de los pueblos conquistados por los hijos de los esclavos liberados de Egipto, la lectura se centra en el aspecto de la ocupación de la tierra. Una lectura actualizada desde esta perspectiva podrá ayudarnos a echar luz sobre las resonancias bíblicas en la actualidad de Palestina/Israel.   • An interpretation of Servil Wars
    [Résumé]

    Wheras some, such as Stalin, maintained that the slave revolts which took place between 140 and 70 BC contributed to the fall of slave society more than five hundred years later, others, such as Badian propose that they had no importance at all. This means, first that the appraisal of its importance poses a problem and that it is conditioned by ideology. It is clear, in any case, that slavery persisted through the Middle Age and the Modern Era until the 19th century, but from a certain point in different parts of the Roman Empire it ceased to be themain factor in the creation of exceeding product and became, partly domestic and partly an ostentatious object. It is thus necessary to try to understand the revolts’ importance in its own terms by assuming an explicit hermeneutical position.   • Of Exodus and Slaveries. Reading the Bible through Cananean’s Eyes. In memoriam Edward Said
    [Résumé]

    The second book of the Torah –The Exodus– is read by the liberation theology as a paradigmatic text of rupture with slavery. Going beyond the interdisciplinary debates of archaeologists and historians which deny the historical fact of the Egypt exodus it describes, the criticism to slavery is what stands out in the reading of these pages. For Exodus, slavery is a temporary situation, and it always aims at the recovery of freedom. From a contemporary philosophical point of view, the heteronomous levinasian ethics is nurtured by the biblical anti-slavery sensitivity, by the memory of the slaves, to carefully craft its notion of “difficult freedom”. In accordance with Levinas heteronomy, as heteronomous readers, we will respond to the Palestinian thinker Edward Said’ s call to “read the Bible with the eyes of the Canaanites”. We will respond to this call to the rhythm of the Hebrew slaves chorus in the opera Nabucco by Verdi. From the point of view of the peoples conquered by the descendants of the slaves who were liberated in Egypt, the reading is focused on the aspect of land occupation. A new reading from this perspective will help us shed light on the biblical resonance in the current Palestine/Israel landscape. Keywords: Exodus, Slavery, Exile, Liberation, Occupation.

  • Slaves in Magnesia: a Passage from Plato’s Laws (VI, 776b-778a)
    [Résumé]

    This paper analyses from a historical point of view the debatable reference to slavery in Plato’s Laws. In concrete terms, some of the founder of the Academy’s most famous theories, in fragments 776b-778a, are reexamined. Specific attention is paid to analyzing Plato’ s proposal on how useful slaves can be in the ideal state he calls Magnesia. Such a proposal is to be understood as an idealistic alternative to the issue of the slaves’ function in Greek poleis during the classical period. Plato’s fundamental interest in reformulating the usefulness of slaves in Magnesia corresponds to the optimization of all the internal aspects of life in the polis.

    Mi propósito en este trabajo es dar una imagen de los esclavos en la obra del orador Iseo, que juegan alternativamente en los papeles de objeto y de sujeto, a partir de una definición que del esclavo da Aristóteles en la Política, y de otras consideraciones en los tratados de retórica (la Retórica del mismo estagirita y la Retórica a Alejandro), así como de fragmentos de los discursos mismos del orador.   • How the Slaves Appear in the Works of Orator Isaeus
    [Résumé]

    In this work what I claim to do is to show how the slaves appear in the works of orator Isaeus alternatively as objects and as subjects. For that purpose I analyse a definition of the term “slave” in Aristotle’s Politics, as well as in other treaties of Rhetoric (namely Aristotelian Rhetorica and the Rhetorica ad Alexandrum), and present some fragments of Isaeus’own speeches.     La relación de dependencia entre cartagineses y libios y la rebelión de los mercenarios
    [Résumé]

    En este trabajo planteo como objetivo analizar la participación de los súbditos de los territorios libios dependientes de Cartago en la guerra de los mercenarios a partir de los testimonios sobre los hechos. Me parece necesario abordar el desarrollo del conflicto dentro de un contexto más amplio, por un lado, como consecuencia de las políticas de endurecimiento tributario en desventaja de los libios a raíz de los gastos generados por la guerra con Roma; por otro lado, incluirla dentro de las revueltas internas o civiles a la que se enfrentó Cartago a lo largo de su historia. A partir de lo anterior propongo un acercamiento a la forma de dominio implantada por el estado cartaginés en el norte de África.   • The Relationship of Dependence between Carthaginians and Lybians, and the Rebellion of Mercenaries
    [Résumé]

    In this paper, I intend to analyze the participation of the subjects of Lybian territories who depended on Carthage to the mercenaries’ war, with reference to testimonies on facts. It seems necessary to place the way this conflict developped in a broader context: on the one hand a consequence of a toughening of tax policies, to the Lybians’ detriment, because of the expenditure caused by the war on Rome; and on the other hand it must be included into internal or civil rebellions that Carthage had to face in history.     Mientras que algunos, como Stalin han sostenido que las rebeliones de esclavos que tuvieron lugar entre 140 y 70 a.C. contribuyeron al derrumbe de la sociedad esclavista más de quinientos años después, otros, como Badian, afirman que no tuvieron importancia alguna. Esto significa, en primer lugar, que la definición de su importancia es problemática y está muy condicionada por la ideología. Es claro, en todo caso, que la esclavitud persistió durante la edad media y la época moderna hasta el siglo xix, pero a partir de cierto momento en distintas partes del Imperio Romano dejo de ser el contribuyente fundamental del producto excedentario para pasar al trabajo doméstico y la ostentación. Entonces, hay que tratar de entender la importancia de las rebeliones en sus propios términos y asumiendo una posición hermenéutica explícita.   • Spartacus in Italy between the Eighteenth and the Nineteenth Centuries
    [Résumé]

    Our aim is to retrace the history of the interest in Spartacus in Italian culture beginning with the date (1726) when the Neapolitan Claudio Porsile’s opera Spartacus was staged in Vienna, up to 1821, when Alessandro Manzoni planned a tragedy on Spartacus, which was never completed. We intend to connect the renewed interest in the figure of the Thracian gladiator with the Enlightenment criticism of the modern age phenomenon of the slave trade, and to highlight the influence of the French on the Italian culture of that period.     La esclavitud en las fuentes del Derecho romano. Su recepción en la Información en Derecho de Vasco de Quiroga (México, siglo XVI)

    El texto presenta algunos elementos en torno al tema de la esclavitud contenidos en las fuentes del derecho romano, particularmente tomados de pasajes de las Instituciones de Justiniano (siglo VI d.C.), que, en el contexto del encuentro de dos mundos, fueron recibidas y actualizadas en un ámbito distinto al europeo, en la obra jurídica de Vasco de Quiroga. Este pensador fue también un hombre de acción que, con actitud visionaria, llevó a cabo en Nueva España (México) una importante obra política, social y educativa, inspirada en una profunda formación humanística y jurídica, misma que puso en juego al tener que responder a las medidas esclavizantes emitidas desde España o promovidas por españoles que habían pasado a territorio americano.   • Slavery in the Sources of Roman Law. Their Reception in Información en Derecho of Vasco de Quiroga (Mexico 16th Century)
    [Résumé]

    The text presents some elements about the subject of slavery contained in sources of Roman Law, particularly taken from passages of Justinian Institutions (6th century a.C.) that in the context of the meeting of two worlds were received and updated in a different non European area, in the legal work of Vasco de Quiroga. This theorist was also a man of action that with a visionary attitude did in New Spain major political, social and educational works, inspired by a deep humanistic and legal training, which he put into practice in his reaction to enslaving measures attempted from Spain or promoted by Spaniards who had come to American soil.     Los esclavos y la justicia real en la ciudad de México (1590-1624)

    Este artículo examina la actuación de los esclavos y sus propietarios en los tribunales reales y ordinarios de la ciudad de México entre 1590 y 1624. Se estudian un conjunto formado por 117 expedientes judiciales, en los que se puede caracterizar el papel de los pleitos y los juzgados como escenarios de confrontación y negociación entre la agencia de los esclavos y los intereses de los amos, cuya interacción produjo un lenguaje que promovió la noción de libertad como mercancía. Asimismo, se presentan los pleitos judiciales como fuente privilegiada, junto a las colecciones legislativas y los tratados, para el estudio de las relaciones entre grupos distintos, productores de prácticas e ideas compartidas.   • Slaves and Royal Justice in Mexico City (1590-1624)
    [Résumé]

    This paper examines the performance of the slaves and their masters in royal courts of Mexico City, between 1590 and 1624. It focuses on a group of 117 lawsuits, which can characterize the role of litigation and the courts as stages of confrontation and negotiation between the agency of slaves and the interests of the masters. That interaction produced a language that promoted the notion of freedom as a commodity. Also, this paper defines the lawsuits as a privileged source, besides the legal collections and treatises, for the study of relations between different groups, producers of common practices and shared ideas.     Discurso sobre la esclavitud y propuestas preabolicionistas en los mundos ibéricos (siglos XVI-XVII))

    La cuestión de la esclavitud en la Época Moderna se vincula estrechamente a la llegada de los europeos a América y de la colonización del Nuevo Mundo. Si fueron intensos los debates sobre si se debía esclavizar a los americanos y, en menor medida, si era justa la trata de los negros africanos, la esclavitud en sí no fue cuestionada por los españoles antes del siglo XIX. Sin embargo hubo algunas excepciones con las que se condenó rotundamente la privación de libertad tanto de los africanos como de los habitantes de los territorios recién colonizados: el portugués Fernando Oliveira (1507-?), los españoles Diego de Rosales (1601-1677) y Francisco de Jaca (1645-?) y el franco-borgoñón Épiphane Dunod o de Moirans (1644-1690). Sobre todo los dos últimos supieron levantarse contra la institución esclavista censurándola en todos sus aspectos gracias a sendos tratados que escribieron en América mientras estaban detenidos antes de su expulsión hacia Europa. Llamaremos preabolicionistas a estos hombres cuya voz fue reprimida por las autoridades y que no llegó a ser oída de los abolicionista de la época contemporánea. Sin embargo nos aportan la prueba de que en aquellos tiempos se podía desarrollar un pensamiento antiesclavista. Palabras claves: Esclavitud, América, abolicionismo, siglo XVII.

  • Speeches on Slavery and Pre-Abolitionist Proposals in Iberian Worlds (16th-17th Centuries)
    [Résumé]

    The question of slavery in modern times is closely linked to the arrival of Europeans in America and to the colonization of the New World. If heated debates did take place in order to know whether one should reduce Americans into slavery or not, and to a lesser extent to know whether the commerce of Africans was right, slavery itself was hardly ever put into question by the Spaniards until the 19th century. Yet there were exceptions when the stripping of the Africans’ freedom, or of the freedom of the inhabitants of recently colonized territories, was actually categorically condemned: Fernando Oliveira (1507-?) the Portuguese, Diego de Rosales (1601-1677) and Francisco de Jaca (1645-?) the Spaniards, as well as French-Burgundese Epiphane Dunod (1601-1677) or De Moirans (1644-1690). The latter two, mostly, managed to face the institution of slavery, censoring it in all its aspects thanks to the treatizes they both wrote in America during the imprisonment preceding their expulsion to Europe. We shall call pre-abolitionists these men who were silenced by authorities and whose words never reached contemporary abolitionists. They bring evidence that even in their times anti-slavery thinking was possible. Keywords: Slavery, America, Abolitionism, 17th Century.

    Spartaco in Italia fra Sette e Ottocento
    [Résumé]

    Si ricostruisce la storia dell’interesse per Spartaco nella cultura italiana dal 1726, quando fu rappresentata a Vienna l’opera Spartaco del napoletano Claudio Porsile, al 1821, quando Alessandro Manzoni progettò una tragedia Spartaco, che peraltro non fu mai condotta a termine. La ricerca mira a collegare il nuovo interesse per la figura del gladiatore trace con le polemiche illuministiche contro il moderno fenomeno della tratta degli schiavi, consentendo di apprezzare l’influenza della cultura francese su quella italiana in quel periodo.     Studi comparati dei sistemi servili antichi e moderni nella storiografia contemporanea

    Il settore della scienza storica dell’antichità maggiormente aperto all’apporto della sociologia –secondo la grande lezione di Max Weber e Karl Marx– da tempo analizza il fenomeno della schiavitù antica in relazione a fenomeni economici e strutture sociali non necessariamente limitati alle società schiavistiche del passato. Per citare solo alcuni tra i maggiori studiosi, M. Finley, K. Hopkins, A. Carandini e W. Scheidel hanno indagato i concreti riflessi che la schiavitù nelle sue varie forme (domestica, rurale, di piantagione) ha gettato sull’ economia e la società dell’Impero romano in un’ottica comparativa (confronto con la schiavitù degli Stati americani del Sud). L’indagine proposta ha la finalità di ricostruire una breve storia del pensiero contemporaneo sui sistemi servili antichi e moderni, in cui impostazioni teoriche e orientamenti ideologici determinano suggestive letture dell’economia politica degli antichi e dei moderni.   • Comparative Studies of Ancient and Modern Slave Systems in the Contemporary Historiography
    [Résumé]

    The Science of Antiquity more open to the contribution of sociology (according to the great lesson of Max Weber and Karl Marx) for a long time examines the phenomenon of ancient slavery in relation to economic and social structures, which are not limited necessarily to slave societies of past. To name just some of the major scholars, M. Finley, K. Hopkins, A. Carandini and W. Scheidel investigated the concrete impact that slavery in its various forms (domestic, rural, plantation) has thrown on the economy and the society of the Roman Empire under the comparative aspect (through a comparison with the slavery of American States of the South). The research aims to reconstruct a brief history of contemporary thought on ancient and modern slave systems, in which theoretical approaches and ideological orientations determine suggestive readings of the ancient and modern political economy.     Es bien sabido que Arnaldo Momigliano fue un maestro de la hermenéutica, y así lo puso de manifiesto a través de su incansable crítica de la historiografía antigua y moderna. En este aspecto, aunque el historiador piamontés no abordó directamente el estudio de la esclavitud y las formas de dependencia, sí que destacó como crítico de las obras fundamentales que se publicaron sobre el tema a lo largo de su vida. En la presente comunicación nos proponemos realizar un vaciado exhaustivo de sus trabajos reunidos en los Contributi alla storia degli studi classici e del mondo antico (1955-1992) con el objetivo de evaluar su implicación en el tema y el contexto histórico y vital en el que el autor se movió.   • Slavery and Relationship of Dependence in the Hermeneutics of Arnaldo Momigliano
    [Résumé]

    Arnaldo Momigliano was a leading scholar on hermeneutics, carrying out a lot of works on ancient and modern historiography. He did not produce studies on slavery and forms of dependence, but he published several reviews of the main works on these topics. The aim of this paper is to analyze his works compiled in Contributi alla storia degli studi classici e del mondo antico (1955-1992), trying to identify and study his ideas on slavery and forms of dependence in Antiquity.
